The client should hire an experienced representative who can act as a professional client advisor and ensure that the entire process—from the client’s initial concept to the building’s operation—is carried out to a sufficient standard of quality and is properly documented.

👉 During the design phase:

The client should hire a third-party design manager to oversee the design work. This third party helps raise the quality standards for all parties involved in the design process. It also means that the contractor can subsequently work from a more thorough and clear basis. The client should have a solid project foundation to avoid conflicts and cost overruns on the project.

👉 During the performance period:

The client should hire a qualified and experienced project manager who is familiar with the standard terms and conditions of the construction project, as well as technical specialists who can oversee the work. This project manager must keep track of financial matters and manage and coordinate the parties involved in the project. It is important that the client has a dedicated resource available who can closely monitor the project and promptly raise concerns with the parties involved if work is not performed to a sufficient extent or quality. If the project manager does not raise concerns in a timely manner, the client risks incurring financial losses.

The developer bears the risk of construction defects vis-à-vis the buyers or tenants of the property. In most cases, the developer can assert claims against the construction contractors.

When assessing liability for substandard construction work, several factors are taken into account, including whether the project documentation provides sufficient information, whether the work was performed correctly, and whether the building was subsequently maintained properly.

Overall, it is crucial for the client to have dedicated resources and experienced project managers on hand to avoid conflicts, cost overruns, and financial losses on the project.
